You must be at least 18 years old to use the Service or create an account. By using the Service, you represent that you meet this requirement.
You agree to notify us immediately at support@real-smartscan.com of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your credentials.
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or conduct that harms other users or the platform.
Prime Elite is a monthly recurring subscription billed at $9.99 USD per billing cycle. Your subscription will automatically renew each month unless cancelled before the renewal date.
SmartCast Pro is a monthly recurring subscription billed at $49.00 USD per billing cycle. SmartCast Pro includes all Prime Elite features plus broadcaster permissions, deal publishing tools, analytics dashboards, and AI credibility scoring. Your subscription will automatically renew each month unless cancelled before the renewal date.
All payments are processed securely by Stripe, Inc. We do not store your full credit card information. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
We reserve the right to modify subscription pricing. We will provide at least 30 days' notice of any price change. Your continued use of the Service after the effective date of a price change constitutes your acceptance of the new price.
A limited free tier is available with restricted features. We reserve the right to modify or discontinue the free tier at any time with 30 days' notice.
When you make a purchase through SmartScan Direct (the "Buy Here" feature), R.E.A.L. SmartScan / ThingkTangk Labs is the merchant of record. We are responsible for the transaction, including payment processing, fulfillment coordination, and customer service for those purchases.
SmartScan Direct listings represent products available at the time the listing was created. Product availability, pricing, and specifications are subject to change. We make reasonable efforts to ensure accuracy but cannot guarantee that all listings reflect current inventory or pricing.
Orders placed through SmartScan Direct are subject to our acceptance. We reserve the right to cancel any order, in whole or in part, for reasons including but not limited to: pricing errors, product unavailability, suspected fraud, or violation of these Terms. If we cancel your order, you will receive a full refund.
Returns and refunds for SmartScan Direct purchases are governed by our Refund Policy. Physical goods are eligible for return within 30 days of delivery in original, unused condition.
Estimated delivery times are provided at checkout and are estimates only. We are not responsible for delays caused by carriers, customs, or circumstances beyond our control.
By uploading, posting, or submitting any content ("User Content") to SmartCast Pro, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, display, distribute, and promote that content within the SmartScan platform.

SmartCast Pro content is subject to AI-powered credibility scoring. We reserve the right to restrict or remove content that scores below credibility thresholds or that is flagged for review.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM; OR (B) $50.00.

Easy Cancellation: You may cancel your Prime Elite or SmartCast Pro subscription at any time through your Account Dashboard or by contacting us at support@real-smartscan.com. Cancellation takes effect immediately — you will not be charged for the next billing cycle.

Before initiating any formal dispute, you agree to contact us at support@real-smartscan.com and attempt to resolve the dispute informally for at least 30 days.
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service (collectively, "Disputes") will be resolved by binding individual arbitration, rather than in court. This includes claims based on contract, tort, statute, fraud, misrepresentation, or any other legal theory. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AND THINGKTANGK LABS EACH AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
Nothing in this Section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened misappropriation of intellectual property rights, or for claims falling within the jurisdiction of small claims court.
You may opt out of the arbitration agreement by sending written notice to support@real-smartscan.com within 30 days of first agreeing to these Terms. Your opt-out notice must include your name, email address, and a statement that you wish to opt out of arbitration.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action not subject to arbitration under Section 16 shall be brought exclusively in the state or federal courts located in the State of Delaware, and you consent to personal jurisdiction in those courts.
We reserve the right to update these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, notify you by email or through a prominent notice in the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
